Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  A PURCHASE OR RENTAL OF A DVD WILL NOT IMPROVE YOUR CHANCES OF WINNING. 

Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. Myriad Travel Marketing “Asia Now” Sweepstakes ("Sweepstakes") will begin at 12:00am Eastern Standard Time (EST) on June 1, 2009 and end at 11:59pm Pacific Time (PST) on July 31, 2009 ("Sweepstakes Period"). Sweepstakes is sponsored by Myriad Travel Marketing 1334 Parkview Avenue, Suite 300 Manhattan Beach, CA 90266, (the "Sponsor") who is solely responsible for all aspects of this Sweepstakes. 

Eligibility: Sweepstakes is open only to individuals who are (i) legal residents of the United States and living in one of the 50 United States or the District of Columbia, and (ii) are 18 years of age or older at the time of entry. Employees, officers, directors and representatives of Sponsor and Administrator (see below), its parent company, affiliates, subsidiaries, licensees, service providers, advertising and promotion agencies, those involved in the production, development, implementation or handling of the Sweepstakes, any agents acting on behalf of the above entities, as well as the immediate family members (parents, children, siblings, spouses) and/or persons living in the same household (whether related or not) of each are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. Void where prohibited, taxed or otherwise restricted by law.

Two Ways to Enter:
1) Participants may enter the Sweepstakes by simply completing the online Sweepstakes registration (name, address, email address, age, and travel preferences) at www.discoverasianow.com. All entries must be received by 11:59pm PST on July 31, 2009.

2) Participants may enter the Sweepstakes by mail by hand-printing on a 3”x 5” card your name, date of birth, address (including ZIP code), day & evening phone numbers and email address, and mailing the card to: “Asia Now” Sweepstakes, 90 Rockwood Place, Rochester, NY 14610. All mail-in entries must be postmarked by July 31, 2009, and received by August 4, 2009. Sponsor is not responsible for lost, delayed, late, incomplete, invalid, unintelligible, illegible, stolen, damaged, misdirected or postage due mail and/or entries and such mail/entries will be disqualified. No photocopies or other mechanically reproduced entries permitted.

Sponsor reserves the right to disqualify any person or email address that submits more than one entry regardless of entry method. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the entrant. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor which is final and binding in all matters relating to the Sweepstakes. All entries become the property of the Sponsor and none will be acknowledged or returned.

Internet Limitations of Liability:  If for any reason, this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process (if applicable), and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prize using all non-suspect eligible entries received as of the termination/suspension date.  Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor also is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure or delay of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof.  Sponsor is not responsible for any damage to an entrant’s system which is occasioned by participating in this Sweepstakes or by downloading any information necessary to participate in the Sweepstakes.  Sponsor also is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes.  Any dispute or claim arising out of the play of this Sweepstakes, or any disputes with site users which arise as a result of the use of this website, shall be governed by the laws of the State of New York, without respect to conflicts of laws principles.  Any such claim shall be brought and maintained in the federal or state courts of the State of New York.  If any provisions of the Official Rules are determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision.  CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Prizes: One (1) Grand Prize winner will receive a trip for two (2) people to Tokyo, Japan, and Seoul, South Korea for 7days/6nights (3 nights per city). The prize package includes economy airfare from Los Angeles LAX to Tokyo and from Seoul to San Francisco SFO on Singapore Airlines. If the winner and their companion want to go back to Los Angeles, a free add on a major carrier can and will be arranged. The trip also includes inter-island airfare from Tokyo to Seoul, three (3) nights stay at the Keiko Plaza in Tokyo, three (3) nights stay at the Lotte Hotel in Seoul, half (1/2) day city tour in both Seoul and Tokyo, and buffet breakfast for two (2) people daily in both Seoul and Tokyo. Travel must be taken between August 21, 2009 and December 5, 2009, OR, between January 15, 2010 and March 31, 2010. All travel arrangements are based on availability at the time of booking. Additional black out may apply during Chinese New Year in 2010. The Grand Prize package has an Approximate Retail Value (“ARV”) $4,980. The Sponsor reserves the right at its sole discretion to substitute the prize with another prize of equal or greater value in the event that any aforementioned prize is not available. All decisions by Sponsor as to prize winner and prize are final.

Prize Conditions: The Grand Prize winner is solely responsible for all applicable federal, state and local taxes and/or any other fees/costs associated with the prize or receipt of the prize. The winner will be required to sign and return an Affidavit of Eligibility and Liability / Publicity Release (unless prohibited) within 14 days of written notification or prize winner will be disqualified. The Grand Prize travel companion must also execute and return a travel release. If travel companion is a minor, parent or legal guardian must sign and return the release and accompany minor on trip. In the event of noncompliance with the Official Rules, if a winner cannot be reached at the address/phone number on winner’s entry within 5 days of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected. The prize will be only awarded to a verified winner. The winner’s entry and acceptance of the prize constitutes permission (except where prohibited) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.

Drawing and Notification: The winner will be selected from among all eligible entries received by either entry method, in a random drawing conducted on or about August 10, 2009 by American Sweepstakes & Promotion Co. (“the Administrator”) an independent judging organization, whose decisions are final and binding in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received by either entry method.  Potential winner will be notified by phone and/or mail. Upon initial notification and verification of potential winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor’s choice. 

Terms & Conditions: By entering the Sweepstakes, entrants agree to release Sponsor and its parent company, subsidiaries, affiliates, retailers, distributors and advertising and promotion agencies, and its and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries of any kind sustained in connection with their participation in the Sweepstakes or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize.  Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose.  Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the fullest extent of the law.  By participating, entrants agree to waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these Official Rules. By participating in the Sweepstakes, entrants agree that the Sponsor has the right to send marketing, promotional, or other materials and information from the participating marketing partners.
